Isn’t a sharps injury a hazard of the job when working in the healthcare sector?
Yes, it is but that does not mean that your employers are not responsible or that they can refuse compensation. Your employer should take all reasonable steps to ensure your safety while at work and this includes making sure that your colleagues do nothing to endanger your health.
I didn’t contract a blood-borne virus (BBV) can I still claim?
Yes, you can claim for the stress and worry as a result of the need to undergo blood tests to see if you have contracted BBV.
How long do I have to bring my claim?
You have three years from the date of the incident to issue proceedings in support of your claim, however, the sooner the better to ensure that all the evidence we need to bring your claim is still available.
The Courts can extend this three-year period but only in exceptional circumstances.
How much is my claim worth?
The amount of compensation you may receive depends on a number of things; how the incident affected you, whether there was a need for PEP, the length of time you had to wait for your results etc. We would rather give you a valuation based on your circumstances than give a random figure that may bear no relation to your claim.
