Dog Ownership Disputes

Dog Ownership Disputes. If you are in dispute over the ownership of a dog we are able to assist the parties in reaching a solution.

The majority of dog disputes arise following the breakdown of a relationship. We understand that this can be stressful and upsetting enough without the added pressures of a dispute in relation to the family pet.  Here at Cohen Cramer we can assist and support you through this process.

What is the law?

Pet ownership rights are governed by the Torts (Interference with Goods) Act 1977. Under this Act, a claim for ownership may be brought against another party if you allege that you own the pet in dispute. The remedies available are delivery-up of the animal and/or consequential damages. Whether you are bringing the claim or defending it, the matter will rely on the facts and the evidence in support of ownership.

How can we help?

Recovery

Whether you are seeking the recovery of your pet, or proceedings have been brought against you, we are able to assist with bringing and defending such claims.

Advance planning

We can prepare an agreement when you enter into a relationship setting out the position should the relationship breakdown. An agreement such as this works very much like a pre-nuptial for your pet(s). This can prevent the added expense of litigation at a later date.
