The recovery of money owed, whether to you as an individual or to a company or partnership is a sensitive area and it is important that the process is managed promptly and with skill.  At Cohen Cramer we understand the importance of providing advice on the best options available for debt recovery and on achieving a quick resolution.  Our dedicated Debt Recovery team is highly skilled in getting the best possible result in the quickest time frame possible.

Why not take a look at our Debt Recovery Flowchart which explains the process involved in recovering debts owed to you. We can offer a simple and cost effective procedure for managing your bad debts, which are explained in more detail below.

(i)        Pre-legal correspondence by solicitors

This is essentially a fourteen-day Pre-Action Protocol letter threatening proceedings in the event that debts are not settled.  The letter is quite comprehensive and is compliant fully with the Civil Procedure Rules. This will have the effect of removing a substantial proportion of your debts from the strategy.

(ii)       Issue proceedings against all outstanding debtors (under £10,000)

The most successful debt collection strategies have a formal policy as to when proceedings are to be issued which is followed in all cases.  Again, the simple issuing of proceedings will result in a large proportion of outstanding debtors at this stage making payment or coming to a payment arrangement. We will draft the necessary Court documents on your behalf and issue at Court.

Please note at this stage a Court issue fee is payable which varies depending on the amount of your claim (the Court fee structure can be found by clicking this link).

To find out about of various funding packages get in touch with us today.

Once the claim is issued and served by the Court, the debtor will have 14 days in which to respond formally to the claim. In the event they fail to do so, we will request Judgement in default on your behalf.

In the event enforcement proceedings are required if payment is still not received from the debtor, we will provide you with a separate fee quote.

(iii)      Disputed and defended cases (over £10,000 outstanding)

There will be a small proportion of disputed and defended cases, perhaps a handful each month, and these will then fall outside the normal debt collection strategy. These cases will often require more time and more input from you as the creditor. In these circumstances we would be happy to run through the options available to you and agree costs to be on a staged fixed fee basis.
